16.1 Legacy Series / [SOLVED] 16.1.8 will not install on Hyper-V

Tried twice to install on hyper-V (2012-R2) using the 16.1.8.ISO
It fails on /usr/local/bin/cpdup -vvv -I -o /usr/include/mnt/usr/include
Return code 1
